When Katie and Tom got married over in Italy, they came back here and made it official in New York City. I don't know it I am correct, but anytime you get married outside the United States, you have to come back and make it legal. So you would have to get a divorce in the same exact place where the marriage certificate was filed at.

to answer Natasha Jean... My ex-husband and I were married in New Jersey and Divorced in Ca. You have to file in the state where you live more than six months maybe two years before you can file to establish residency which is what Kate Holmes did. Perhaps this was something she had planned for a while with that in mind. My divorce attorney was from the same law firm as Tom Cruise. My ex-husband who also had an attorney in Ca. retained an attorney from the Skoloff & Wolfe law firm in Livingston NJ since the matter had been transferred to NJ on a stipulation because the children and I moved back to my home state of New Jersey. Divorce in different states can be very expensive and confusing. Katie will have to hire Ca. attorney as well. Good luck.
