On May 4, 2012 the Pavilion Apartments Tenant President Mr. Sam August was served with Landlord-Tenant Court papers to appear in court on 6/21/2012 at 8:30 am for posting flyers letting the Pavilion Tenants know of the next meeting date/time/place.  The management Alpha Properties under the guidelines of Mr. Sean Pena have made it quite clear that they do not want any tenant association at this property. And have made it quite clear that they are not sparing any cost to have Mr. Sam August evicted for this action.  But the question remains "did Mr. August post those flyers?" And the last question "Is the Pavilion Tenant Association Civil Rights being violated?" by these unfair tatics of Alpha Properties and Mr. Sean Pena??? Remember this is the Mr. Sean Pena that stood before the Newark Rent Control Board last September 2011 and lied stating that he was one of the owners of Pavilion Properties. I truly believe that this is a personal matter and want Newark Patch and any other media to appear at the courhouse on this date to help Pavilion Tenant Association and Mr. Sam August case and story.

The owners and attorneys are becoming too aggressive. They are in clear violation of the law, and in NJ there is no way to enforce landlord/tenant laws other than litigation. Somehow that has to be changed, unsure how.

Management has brought this action ONLY because they lost a civil case against Mr. August in January. They publically stated at the end of that case that the Judge dismissed on the recommendation of the prosecutor. "that we are left to our other remedies I guess." To which Judge Bahir Kamil replied, "Absolutely." I attended this hearing and heard these statements and also have read the transcript of the hearing. In the meantime, tenants have suffered through asbestos removal with no visible work permit, no hot water in the laundry room, an out-of-order restroom in the laundry room that I did not know was there in all the 12 years I have lived here and complaints about tenants smoking cigarettes and pot but Alpha Properties would rather spend their money (they said so) on removing one man. If this isn't a violation of civil rights, I don't know what is.
