Irvington Man Charged with Vehicular Homicide

57-year-old city resident killed after his car was rammed last year at 'high rate of speed'

The Essex County Prosecutor’s Office (ECPO) has announced the arrest of a man for the second-degree vehicular homicide of Stewart Barnes, a 57-year-old city resident, late last year.

Frank T. Marshal 27, of Irvington, was driving north on Norfolk Street at “a high rate of speed” on the afternoon of Dec. 10, 2011, when he struck Barnes’s vehicle, according to an investigation by Newark police and the vehicular homicide section of ECPO’s Major Crimes Task Force.

Barnes was pronounced dead a short time later at University Hospital.

The matter was presented to an Essex County grand jury, which returned an indictment against Marshal charging him with vehicular homicide. A warrant was issued for his arrest by Judge  Peter J. Vazquez, P.J. Cr., who set bail at $50,000. Marshal was remanded to the Essex County Correctional Facility pending arraignment before Vazquez.

If convicted, Marshal faces up to 10 years in prison.
